Applicant Requirements

Companies

- One qualifying company outside the U.S. and one inside the U.S.
- The U.S. company must have been actively operating for at least one year at the time of filing, whether newly formed or acquired.
- Both companies must be connected through shared ownership or control, qualifying as a parent company, subsidiary, affiliate, or branch.

Common ownership

- One individual holds a controlling interest of 51% or more in both companies.
- One company directly owns the other, establishing a parent-subsidiary relationship.
- The same individual or group of individuals owns an equal share in both companies.


Note: This ownership structure must remain in place through the date the Green Card is issued.

Petitioner

- The petitioner must hold a managerial or executive position at the foreign company.
- The petitioner must have worked for the foreign company for at least one continuous year within the past three years.
- The petitioner must oversee and manage other staff members.

Foreign company

- The company has been in operation for at least one year.
- The company has 15+ employees under the petitioner's supervision.
- Employees receive an official salary.
- The company has a three-level management structure: leader → managers → operational or administrative employees
- The company is in good standing.

U.S. company

- The U.S. company must have been actively operating for at least one year at the time of filing
- The company must have enough staff to support a genuine managerial or executive role.
- The company must have a clear hierarchy of command with three levels.
- The company must be able to pay the petitioner's salary.
