Advantages

You can file an O-1 visa petition at any time. USCIS offers Premium Processing, which guarantees a response within 15 days, while standard processing typically takes around 6 months.

Unlike the H-1B, the O-1 visa is not subject to a cap. Approximately 20,000 of these visas are issued annually based solely on applicant merit.

It is much easier to refine your EB-1A (Green Card) case once you are already in the U.S. on an O-1. This allows you to build local achievements that will be most effective for your long-term immigration strategy.

Spouses and children under 21 are eligible for O-3 non-immigrant visas, allowing them to live in the U.S. for the same duration as the primary applicant. While O-3 status does not grant work authorization, it does allow for full-time study.

The O-1 is not just for tech experts and scientists. It is available to professionals in a wide range of industries – from designers and bloggers to C-level executives.

Live and work in the U.S. for the entire duration of your visa (typically 1 to 3 years). The O-1 can be extended indefinitely in one-year increments as long as you continue your professional activities.
